Conditions of Use

Oak Piece Nursery is a nursery, propagating, growing and retailing a broad range of ornamental plants. Most of the plants listed on the website are perennial and the vast majority is fully hardy. I like to grow plants that succeed without a lot of cultural problems, partly because it makes producing them easier, but also if a plant thrives for a customer it gives him, or her, the confidence to buy more from me. Many of my plants are grown in reduced peat compost produced on site. I adjust the pH by adding Magnesium limestone and add the fertilizer and trace elements necessary for healthy growth.

Whilst I am full of the best intentions to keep this web site as up to date as possible, gardeners and plantsmen will appreciate that given choice the between doing nursery work or computer work, the nursery work will win every time. New plants are added regularly to the plant list, but probably only added to the web site once during the growing season.

I pride myself on the quality and reliability of my plants.

This web site is for customers checking availability before visiting, and for mail order customers.

Plants sent by mail order are the same size and quality as those sold at the nursery. I only sell well grown plants. If I have stock that is not properly established I will decline your order until later. On the other hand, sometimes the stock will have been potted up into pot sizes too big for mail order, please enquire whether bigger sizes are available, these of course will have to be collected. Orders are usually dispatched on Monday (or Tuesday if Monday is a Bank Holiday) by Royal Mail Standard Parcel Service. All orders will be acknowledged. Where possible I use recycled packaging material for postage and packing. I only dispatch plants to UK addresses, if you are visiting this web-site from a country outside the United Kingdom I apologise but I do not have the capability to handle export orders. The Mail Order service is for well grown 1 litre, 1.5 litre or 2 litre pot sizes. (Bigger pot sizes are available, but not for mail order). Please follow the ordering procedure. I can also accept orders by telephone or fax. Payment. At present I can only accept payment by cheque (you can still order online). All plants remain the property of Charles Ellis until paid for in full.

I believe all plants sent out by me are true to name and every effort is made to ensure they are of the best quality. However no warranty as to description, quality or any other matter is offered. On receipt plants should be unpacked and inspected. If the plants are damaged or are unacceptable to you please contact us. Complaints must be made within 7 days of receipt of goods. I will always try to resolve any complaint as quickly as possible, and to your satisfaction. I will ask for the plants to be returned for exchange or refund. Nothing in this statement should be construed as a change to your statutory rights as a consumer.

You may cancel your order up to the day prior to dispatch. The dispatch date will be as specified above. If you decide to cancel your order you must notify me by telephone on 01386 584077. If the order is cancelled in time, I will refund anything you have paid less a 5% administration charge.

No substitutes are offered unless you requested. I try to keep availability on the website accurate, but if for any reason I cannot supply a plant you have paid for, I will make an immediate refund and let you know.

Postage and packing costs are a combination of Royal Mail standard postal charges and an enough to cover the packing and delivery to a local Post Office.

3 to 5 plants (up to 6 kgs.) £15.75
6 to 9 plants (up to 10 kgs.) £17.50
10 to 15 plants (up to 20 kgs.) £19.50

The above charges are correct at the time but are subject to change without notice.

If the plants are damaged or are unacceptable (for horticultural reasons) please contact us stating the reason. Frivolous reasons (e.g. that Junipers are prickly) will not be entertained.

In placing an order with me or by completing the checkout process you are deemed to have read and accepted these Terms and Conditions.

Visitors to the nursery are always welcome. Our opening times are 10.00 am to 4.00 pm daily (from April to September inc.) Other times strictly by appointment. This site complies fully with the Trades Description Act 1968, Sale of Goods Act 1979 and the EU Distance Selling Regulations 2000.
